These Terms of Service (“Terms”) govern your access to and use of the Fierce AI platform (“Platform”), including all products, services, tools, APIs, and digital access credits provided by Fierce Technologies Corporation (“Company,” “we,” “us,” or “our”).

By accessing or using the Platform, you agree to be legally bound by these Terms. If you do not agree, you may not use the Platform.

1. Eligibility

You must be at least 13 years old to use the Platform.

Users between 13 and 17 may use the Platform only with verifiable parental or legal guardian consent.

The Platform is not directed to children under 13.

We reserve the right to request age verification and to suspend or terminate accounts that fail to comply.

2. Account Responsibility

You are responsible for:

  • Maintaining the confidentiality of your login credentials
  • All activity under your account
  • Providing accurate and current information

We may suspend or terminate accounts for false information, abuse, or security violations.

3. Permitted Use

You agree to use the Platform only for lawful purposes.

You may not:

  • Reverse engineer, scrape, clone, or replicate the Platform
  • Share API keys or credentials
  • Exploit token systems through automation or abuse
  • Generate unlawful, fraudulent, harmful, or infringing content

Violation of these Terms may result in immediate suspension or termination.

4. Platform Ownership

All Platform software, systems, models, branding, and infrastructure remain the exclusive property of Fierce Technologies Corporation.

Users retain ownership of content they upload.

By using the Platform, you grant us a limited, non-exclusive license to host, process, and display content solely to operate and improve the Platform.

5. Tokens

Tokens are digital access credits that permit use of specific features within the Platform.

Tokens:

  • Are not cryptocurrency
  • Are not securities
  • Are not investment instruments
  • Have no cash value
  • Are non-transferable
  • Are not redeemable for currency
  • Do not represent equity or ownership in Fierce Technologies Corporation

Tokens constitute a limited, revocable license to access Platform features and may be modified, suspended, or discontinued at the Company’s discretion.

Tokens may expire in accordance with the expiration terms disclosed at the time of issuance or purchase.

Expired tokens have no value and are not refundable unless otherwise required by law.

6. Service Modifications

We may modify, suspend, or discontinue features or services at any time.

We are not liable for service interruptions resulting from updates or maintenance.

7. Termination

We may suspend or terminate accounts for:

  • Violation of these Terms
  • Fraud or abuse
  • Legal compliance requirements

Upon termination, access to Tokens and Platform services is revoked unless otherwise required by law or written agreement.

Users may close their accounts at any time.

8. Disclaimer of Warranties

The Platform is provided “as is” and “as available.”

We make no warranties, express or implied, regarding:

  • Accuracy of AI-generated outputs
  • Continuous or uninterrupted availability
  • Fitness for a particular purpose

Use of the Platform is at your own risk.

9. Limitation of Liability

To the maximum extent permitted by law, Fierce Technologies Corporation shall not be liable for any indirect, incidental, consequential, or punitive damages.

Our total liability for any claim arising from use of the Platform shall not exceed the amount paid by you in the six (6) months preceding the claim.

10. Indemnification

You agree to indemnify and hold harmless Fierce Technologies Corporation from any claims, damages, liabilities, or expenses arising from:

  • Your use of the Platform
  • Your content
  • Violation of these Terms
  • API misuse
  • Infringement of third-party rights

11. Governing Law

These Terms are governed by the laws of the State of [INSERT STATE], without regard to conflict of law principles.

12. Dispute Resolution

Any disputes arising from these Terms shall be resolved through binding arbitration, except where prohibited by law.

You waive the right to participate in class action lawsuits.

13. Force Majeure

We are not liable for delays or failures caused by events beyond reasonable control, including natural disasters, government action, infrastructure outages, or force majeure events.

14. Changes to Terms

We may update these Terms periodically.

Continued use of the Platform after updates constitutes acceptance of the revised Terms.
